The fight for life: Join these states in the battle to prevent extreme abortion laws and protect life

11 abortion ballot measures are on the ticket this election cycle


With the overturning of Roe v. Wade and Planned Parenthood v. Casey, the battle over life was returned to the states — and 10 states are facing that battle this election season, with 11 total initiatives appearing on the ballot in November, though at least two are the subject of pending legal action.

Most are attempting to enshrine abortion as a state constitutional right. Nebraska alone has a pro-life ballot measure, seeking to amend the state constitution to protect unborn babies.

The real danger of these amendments is that voters often do not understand how far these initiatives reach. Not only do all of these amendments allow abortion up until the moment of birth for virtually any reason, some also may permit infanticide (directly or indirectly killing a baby who survives a botched abortion). Many of them remove health and safety protections for women (including restrictions on who can perform abortions), make it easier for sex traffickers and abusers to cover their crimes, negate parental rights, and will lead to taxpayer-funded abortions.

Now is the time to take a stand for life! We invite you to get involved with those in your home state (or a nearby state) to protect and defend the right to life by doing the following:

Arizona: PRO-ABORTION AMENDMENT WILL BE ON BALLOT

Ballot Initiative: Arizona Abortion Access Act

Constitutional amendment to establish a fundamental right to abortion in virtually all cases before and after fetal viability.

  • Establishes a “right” to abortion in the Arizona State Constitution, permitting abortion up until birth for virtually any reason.
  • Removes the requirement for a medical doctor to be involved and makes critical safeguards unenforceable.
  • Removes parental consent.
  • Makes it easier for sex traffickers and abusers to cover up their crimes.
  • Opens the door for taxpayer-funded abortion.
  • Risks removing conscientious objection protections for health-care providers who opt out of abortion procedures.
  • May permit infanticide after a baby is born alive.
  • Join the It Goes Too Far campaign, with options to make phone calls, get a yard sign, host an event, join regular Zoom training sessions and more.

Colorado: PRO-ABORTION AMENDMENT WILL BE ON BALLOT

Ballot Initiative: Right to Abortion Initiative (89)

Constitutional amendment to provide a right to abortion and ensure the government cannot prohibit health insurance coverage for abortion.

  • Establishes a “right” to abortion in the Colorado State Constitution, permitting abortion up until birth for any reason.
  • The language states that the government cannot “impede” or “discriminate” against the right to abortion, preventing the enactment of any laws that could delay abortion, such as those related to health and safety, parental consent, and those that help ensure woman are not being coerced into abortion by sex traffickers or abusers.
  • Forces taxpayer-funded abortion
  • May permit infanticide after a baby is born alive.
  • Join the efforts of Right To Know Colorado, a coalition of more than 50 organizations providing volunteer opportunities, events, and educational resources

Florida: PRO-ABORTION AMENDMENT WILL BE ON BALLOT

Ballot Initiative: Florida Amendment 4: Amendment to Limit Government Interference with Abortion

Constitutional amendment to codify unrestricted abortion access, permitting abortion before viability and in virtually all cases after viability, dictating that no law shall prohibit, penalize, delay, or restrict abortion.

  • Amends the Florida State Constitution to permit abortion up until birth for virtually any reason.
  • No parental consent nor informed consent.
  • No health or safety regulations.
  • No qualification requirements for abortionists or abortion clinics.
  • No limit on late-term abortions, including brutal dismemberment abortions.
  • No limit on aborting babies to harvest their organs.
  • No reflection or waiting period.
  • May permit infanticide after a baby is born alive.
  • May make it easier for sex traffickers and abusers to cover up their crimes

Maryland: PRO-ABORTION AMENDMENT WILL BE ON BALLOT

Ballot Initiative: Senate Bill 798

Constitutional amendment to establish that every person has a fundamental right to “reproductive freedom” (including abortion) and to prohibit the state from denying, burdening, or abridging that right without a compelling state interest.

  • Establishes a “fundamental right” to abortion in the Maryland State Constitution, permitting abortion up until birth for virtually any reason.
  • Prohibits parental consent laws.
  • Prevents reasonable health and safety standards for the protection of mothers and their unborn babies.
  • Will require taxpayer funding of abortion.
  • May permit infanticide after a baby is born alive.
  • Makes it harder to detect whether women are being coerced into abortion and easier for sex traffickers and abusers to cover their crimes
  • Note: The amendment also would remove parental rights related to their children undergoing transgender surgeries.
Missouri: PRO-ABORTION AMENDMENT

Ballot Initiative: The Right to Reproductive Freedom Initiative

Constitutional amendment to provide a fundamental right for “reproductive freedom,” defined as “the right to make ... decisions about all matters relating to reproductive health care, including but not limited to prenatal care, childbirth, postpartum care, birth control, abortion care, miscarriage care, and respectful birthing conditions.”

  • Provides a “fundamental right” to abortion in the Missouri State Constitution, permitting abortion up until birth for virtually any reason.
  • Eliminates over 52 pro-life laws, including laws related to reasonable health and safety standards, as well as a requirement to show a mother the ultrasound image of her baby (which would be removed).
  • Ushers in the likelihood of taxpayer-funded abortions.
  • Removes parental consent.
  • May permit infanticide after a baby is born alive.
  • May make it easier for sex traffickers and abusers to cover up their crimes.
  • Note: The amendment would also threaten parental rights related to their children undergoing transgender surgery.
Montana: PRO-ABORTION  AMENDMENT WILL BE ON BALLOT

Ballot Initiative: Ballot Issue 14

Constitutional amendment to provide a right to abortion and prohibit the government from denying or burdening the right to abortion before and after fetal viability in most cases.

  • Establishes a “right” to abortion in the Montana State Constitution, permitting abortion up until birth for virtually any reason.
  • Makes it harder to detect whether women are being coerced into abortion and will likely make it easier for sex traffickers and abusers to cover up their crimes.
  • Prohibits parental consent*
  • Prevents reasonable health and safety standards for the protection of mothers and their unborn babies.

*The Montana Supreme Court recently ruled parental consent for abortion violates the state constitution.

Nebraska (1): PRO-ABORTION AMENDMENT

Ballot Initiative: Protect the Right to Abortion

Constitutional amendment to provide the fundamental right to abortion without interference from the state until, and in virtually all cases after, fetal viability.

  • Establishes a “fundamental right” to abortion in the Nebraska State Constitution, permitting abortion up until birth for virtually any reason.
  • Prohibits parental consent laws.
  • Places the health and safety of woman at risk.
  • Informed consent laws would be at risk, increasing the likelihood of coerced abortions.
  • Makes it so that a woman does not need to see a medical professional in person, or possibly at all.
  • May permit infanticide after the baby is born alive.
  • May make it easier for sex traffickers and abusers to cover up their crimes.
Nebraska (2): PRO-LIFE AMENDMENT WILL BE ON BALLOT

Ballot Initiative: Protect Women and Children Initiative

Constitutional amendment to protect unborn children after the first trimester.

  • Enshrines protections for the unborn in the Nebraska State Constitution in the second and third trimesters, except in a medical emergency or in a pregnancy resulting from sexual assault or incest.
  • Ensures pro-life laws can be enacted in the future.
  • In addition to the above, join the efforts of Protect Women and Children, a group of Nebraska medical professionals who launched the pro-life ballot initiative, with options to volunteer and more.
  • Vote Yes on the Protect Women and Children Initiative.
Nevada: PRO-ABORTION AMENDMENT WILL BE ON BALLOT

Ballot Initiative: The Nevada Reproductive Rights Amendment

Constitutional amendment to provide the fundamental right to abortion until and after fetal viability in virtually all cases, and to prohibit the government from denying, burdening, or infringing the right to abortion without a compelling state interest.

  • Establishes a “fundamental right” to abortion in the Nevada State Constitution, permitting abortion up until birth for virtually any reason.
  • Prohibits parental consent laws from being enacted and ensures Nevada’s current status as a “magnet” for sex traffickers, predators, and abusers continues.
  • Places the health and safety of woman at risk, for example, will lead to a lack of regulation for abortion clinics.
  • Makes it so that a woman does not need to see a medical doctor in person, or possibly at all.
  • May permit infanticide (by neglect) by eliminating the current hospital requirement to provide life-saving care to infants born alive after a failed abortion.

New York: PRO-ABORTION AMENDMENT WILL BE ON BALLOT

Ballot Initiative: Equal Protection of Law Amendment

Constitutional amendment to establish equality under the law, specifically outlining that a person cannot be discriminated against based on “ethnicity, national origin, age, disability, creed, religion, or sex, including sexual orientation, gender identity, gender expression, pregnancy, pregnancy outcomes, and reproductive healthcare and autonomy.”

  • The amendment will likely codify abortion into the New York State Constitution, permitting abortion up until birth for any reason (see here for more).
  • In essence, it would most likely prohibit any restrictions, limits, and regulations on abortion — ranging from parental consent to health and safety protections.
  • May permit infanticide after a baby is born alive.
  • Note: The amendment also has a wide-ranging impact on LGBTQ+ matters, including threatening parental rights related to their children undergoing transgender surgery. Religious institutions and organizations would be prohibited from exercising their sincerely held religious beliefs on human sexuality.
South Dakota: PRO-ABORTION AMENDMENT WILL BE ON BALLOT

Ballot Initiative: Right to Abortion

Constitutional amendment to provide a right to abortion in the first trimester, and in virtually all cases in the second and third trimesters, providing a legal framework to “regulate” abortion after the first trimester.

  • Establishes a “right” to abortion in the South Dakota State Constitution, permitting abortion up until birth for virtually any reason.
  • The amendment may permit killing (directly or indirectly) a baby who is born alive after a failed abortion.
  • Would override several current pro-life laws, including parental notification rights and protections from forced abortions.
  • Makes it easier for sex traffickers and abusers to cover up their crimes.
  • Overrides current health and safety requirements, for example, requiring a physician to be involved in an abortion.
  • Likely renders conscience protections null and void for doctors and nurses who refuse to participate in abortions.

Spread the Word

Since the overturning of Roe, voters in California, Michigan, Vermont, and most recently Ohio have amended their state constitutions making abortion a “fundamental right” in their states. On the other hand, in 2018, voters in Alabama, Louisiana, and West Virginia also amended their constitutions in favor of protecting unborn life. The people of Alabama guaranteed a right to life for the unborn, and both the people of Louisiana and West Virginia declared there was no right to abortion in their states.

While the Dobbs decision was a landmark win for life, the pro-abortion movement’s response was to launch a well-funded and well-organized effort to enshrine abortion in state constitutions. By amending state constitutions to guarantee the right to abortion, many pro-life laws on the books will no longer be enforceable. Many of these amendments will also allow or lead to taxpayer-funded abortions.

Now is the time for the Church to take a stand for life! It’s important to know how to combat this pro-death agenda through lifesaving strategies, education, and mobilization in a post-Roe America. Join us in the fight to protect life!
