On April 14, 2021, Rep. Kat Cammack (R-FL) filed a discharge petition for the Born-Alive Abortion Survivors Protection Act. The Born-Alive Act (HR 619) provides legal protection to babies who survive attempted abortions and requires that they receive the same medical care and attention as any baby born after an attempted live birth. It also provides penalties for any abortionist who fails to provide care for or intentionally kills a newborn.
Speaker of the House Nancy Pelosi has repeatedly blocked the Born-Alive Act; however, if 218 representatives sign the discharge petition, it will force the Born-Alive Act to the House floor for a vote.
House Republican Whip Steve Scalise (R-LA) said, “Last Congress, Speaker Pelosi directed her radical caucus to block the Born-Alive Abortion Survivors Protection Act more than 75 times. ... The Born-Alive Act deserves a vote on the House floor. The American people deserve to know where their representatives stand on taking steps to end infanticide.”
Contrary to the assertions of many abortion proponents, abortion survivors are not “hypothetical.” At least 143 babies were born alive after an attempted abortion between 2003 and 2014, according to the Centers for Disease Control and Prevention (CDC). And this number was derived from the mere eight states that report this information.
In addition, an expert stem cell researcher revealed during the preliminary criminal hearing for Liberty Counsel’s client Sandra Merritt—the undercover journalist who exposed Planned Parenthood’s trade in baby body parts—that studies using baby human hearts had to have been conducted while the hearts were still beating when cut out. That means the babies had to have been born alive.
It should go without saying that infanticide is horrific and unacceptable.
As Rep. Ann Wagner (R-MO), the bill’s sponsor, said, “Every life is sacred and precious—no matter the circumstances of birth [emphasis added].”
Such legislation should not be needed; however, the Born-Alive Act is necessary because sufficient protections do not exist for these innocent abortion survivors. But to pass the necessary Born-Alive Act, it must first be brought to a vote, which is what the discharge petition seeks to do.
