This lawsuit could change everything
Today, opponents of President Trump’s voter-citizenship verification system must answer to the U.S. Supreme Court.
By 4 p.m. today, the League of Women Voters must tell the Court why the Trump administration should NOT have an upgraded federal database to help states determine whether people on their voter rolls are U.S. citizens.
One of their complaints is almost unbelievable. They specifically challenged a feature that lets states check voter records in bulk, arguing that it allows access to too many voter records at once.
Before President Trump upgraded the federal Systematic Alien Verification for Entitlements database — SAVE — officials generally had to search records individually.
One. At. A. Time. The Trump administration changed that.
It made the upgrade so states could upload large batches of voter records and compare them against federal citizenship information. The results were staggering.
Since May 2025, according to the Trump administration’s Supreme Court filing, the upgraded SAVE system verified more than 65 MILLION voters across 26 states as U.S. citizens. But another 28,635 voter records raised red flags as potentially belonging to non-U.S. citizens.
More concerning are the 24 states that refused to use this database. Yesterday, the Senate came back to work.
Now is the time to flood the Senate with demands to do everything possible to pass the SAVE America Act. We cannot rely on the whims of a court to restore election integrity. Send your faxes now telling the Senate to pass the SAVE America Act.
The federal Help America Vote Verification (HAVV) system has produced more than 28 MILLION “No Match” responses in the last 15 years. Yet, 11 states did not use the HAVV system in 2025. Twenty-four states now refuse to use it at all.
The outcome? Millions of registrations may never be checked through this federal citizenship-verification system.
In response, Trump gave states a much faster tool to answer an extraordinarily simple question: Is this potential or current voter an American citizen?
But the League of Women Voters is challenging both the legality of the modifications and their use in large-scale bulk searches, arguing that they create serious concerns about privacy, statutory authority, and accuracy.
Apparently, wasting time checking voters individually was acceptable — but giving states the ability to check thousands of records efficiently created a problem.

A federal judge has already struck down the improved database on privacy grounds. The Trump administration appealed. Now the case is before the U.S. Supreme Court.
And the clock is ticking. The 2026 midterm election is only weeks away. Therein lies the real problem.
Election integrity should never depend on which federal judge gets the case.
It should not depend upon whether judges decide states may search for voter records one at a time, a thousand at a time, or a million at a time.
Congress needs to settle this.
The SAVE America Act would put citizenship protections into federal law rather than leaving election security balanced precariously on executive orders, agency regulations, and emergency Supreme Court appeals.
The SAVE America Act requires documentary proof of U.S. citizenship to register to vote in federal elections. It also requires voter identification, and gives states tools to identify and remove noncitizens from voter rolls.
Liberty Counsel Action is working around the clock on Capitol Hill to push for passage of the SAVE America Act and protect the integrity of American elections.
